SC approves panel for Vikas Dubey encounter probe


Former Supreme Court judge BS Chauhan has been. appointed as the chairman of the three-member inquiry commission on the killing of eight policemen in Kanpur and the .subsequent encounter gangster Vikas Dubey and five of his alleged associates. The same has been approved by the Supreme Court.(Vikas Dubey

Chief Justice SA Bobde instructed the inquiry commission. to start working within a week and complete the probe within two months.

The development took place in a bunch of petitions seeking a court-monitored .probe in the encounter of gangster Vikas Dubey and five of his associates.

Apart from Justice Chauhan, former high court judge Shashi Kant Agarwal .and former director general of police, Uttar Pradesh, KL Gupta are two other members of the probe panel.

Notably, the Uttar Pradesh government had submitted a draft notification.. to the apex court regarding the appointment of the members of the probe panel. The bench after considering the names proposed by the Uttar Pradesh. government cleared the draft and asked the state government to notify it.

The Supreme Court also directed the Union government .to provide secretarial assistance to the probe panel. It clarified that the assistance .should be provided by the National Investigation Agency (NIA) or any other central agency.

The Supreme Court clarified that the probe. panel will have to submit its report to the apex court, .as well as the state government, as per the Commission of Inquiry Act. It also clarified that the scope of the investigation should. be wide enough and it is not in favour of “tying the hands” of the commission.

Representing the Uttar Pradesh government, solicitor general Tushar Mehta said Justice Chauhan has agreed to be a part of the inquiry commission. He also informed the bench that the commission will probe how Vikas Dubey, who had 65 FIRs against him, was out on bail.

Notably, Vikas Dubey was killed in an encounter on July 10 while he was being brought back from Ujjain in Madhya Pradesh to Kanpur. The Uttar Pradesh police claimed that the vehicle carrying Vikas Dubey met with an accident after which the gangster tried to escape from the spot in Bhauti area. in conclusion.
