The Gujarat High Court on Monday granted bail to PSI Shweta Jadeja accused of accepting a bribe from an accused in a rape case.
The court granted bail and asked Jadeja to furnish a personal bail bond of Rs1 lakh with the trial court.
Justice AP Thakkar of Gujarat High Court observed that the “ bail is a rule and jail is an exception” will apply in the present case.
The court took note of the fact that the accused is in jail since July 3 of this year and being a public servant is not likely to flee.
The court also ordered Shweta Jadeja to submit her passport with the court and not leave the state without its permission.
Shweta Jadeja moved the high court after the Ahmedabad Sessions court rejected her bail application.
Advocate Virat Popat submitted before the court that as per the section 437 of CrPC, a woman accused can be released on bail, even if she is facing punishment up to life imprisonment, though in the present case the maximum punishment is up to seven years.
He has also contended that WhatsApp messages exchanged between parties cannot be treated as proof of demand.
Public prosecutor Mitesh Amin argued that there was sufficient evidence on record to suggest that Shweta Jadeja is involved in the corruption offence. He argued that the cop took the money through Angadiya and sent it to a relative.
She also bought a mobile phone at a cost to the complainant.
What is the Shweta Jadeja rape case?
According to the FIR lodged with Mahila Police Station,(west) Ahmedabad, the accused PSI Shweta Jadeja asked a rape accused for bibe for not booking him under Prevention of Anti Social Activities Act (PASA).
She asked the complainant to pay Rs20 Lakhs and later against sought Rs15 lakh form him.
It is alleged that an employee of the complainant paid the bribe through Angadia which was received by one of the co-accused via Devendra Odedara.
It is alleged that co-accused is relative of hers and had received the money on her behalf.
