SC rejects NIA’s petition challenging default bail to Sudha Bharadwaj in Elgar Parishad case

New Delhi: In some relief to activist Sudha Bharadwaj, the Supreme Court has refused to interfere with her bail ordered by the Bombay High Court.

The Apex Court turned down an appeal by the National Investigation Agency (NIA) challenging the default bail granted to Sudha Bharadwaj on December 1 in the Elgar Parishad case.

The Bombay HC had granted default bail to the activist while rejecting the pleas of eight others. It had observed that a stay could not be granted on default bail and left it to the special court to decide on her bail conditions.

Dismissing NIA’s petition on Tuesday, the SC bench of Justices UU Lalit, S Ravindra Bhat and Bela M Trivedi said, “We see no reason to interfere with the high court order.”

 

Elgar Parishad case

The Pune police had claimed that inflammatory speeches had been made at the Elgar Parishad conclave on December 31, 2017. These speeches had led to violence in Bhima Koregaon the next day.

They had further claimed that the conclave was backed by Maoists.

Sudha Bharadwaj had been arrested by Pune police in August 2018. She was initially under house arrest and then taken into custody.

Between then and December 1 this year, Sudha Bharadwaj was granted bail jusnt once for two days to attend her father’s final rites. in 2019.
