Rajasthan HC allows Sachin Pilot to file fresh petition challenging Speaker’s disqualification notice

The Rajasthan High Court on Thursday granted time to Sachin Pilot and 18 other dissident Congress MLAs to file an amended petition challenging the disqualification notices issued to them by the Rajasthan Assembly Speaker CP Joshi.

The petition against the move to disqualify the rebel MLAs from the state assembly was taken up for hearing at 3 pm.

But senior advocate Harish Salve, appearing for the petitioners, sought time to amend it.

Salve submitted before the court that the MLAs wanted to challenge the constitutional validity of the notices and needed some time to file it afresh.

The matter will be now heard by the division bench of the high court.

The Rajasthan Assembly Speaker had sent disqualification notices to Pilot and 18 others asking them to explain why they had skipped the Congress Legislature Party meeting on Monday and Tuesday. The MLAs have been asked to respond to the notices by Friday.

The notices were sent after the chief whip of the Congress in Rajasthan Assembly, Mahesh Joshi, wrote to the Speaker, seeking proceedings against the rebel MLAs in accordance with the Tenth Schedule of the Constitution.

The Congress also cited past Supreme Court rulings to seek their disqualification.

Pilot was sacked as deputy chief minister and the state Congress president on Tuesday after he did not show up at the Congress Legislature Party meetings. Two other ministers in the Pilot camp were also dropped from the Cabinet.

The Congress chief whip alleged that over the past several days, attempts are being made to topple the state government through “corruption, bribery and other illegal means”.
