President Kovind Orders Transfer of Delhi HC Judge S. Muralidhar Day After He Pulls up Police Over Violence


Justice S. Muralidhar transferred just hours after his remarks about registering an FIR against BJP leaders for hate speech and not allowing Delhi to be pushed back into a situation like the 1984 riots. Muralidhar, who heard the petitions on Delhi violence on Wednesday and slammed Delhi Police over continuous violence over 3 days, has been transferred to the Punjab and Haryana High Court. President Kovind has ordered the transfer following the recommendation by SC.

A political row had broken out over the incident, with Congress leader Rahul Gandhi tweeting, “Remembering the brave Judge Loya, who wasn’t transferred.” Loya, who was hearing the high-profile Sohrabuddin Sheikh fake encounter case of Gujarat, had died of cardiac arrest in Nagpur on December 1, 2014, when he had gone to attend the wedding of a colleague’s daughter. Some reports had claimed foul play in his death.


The law minister also came down strongly on Rahul Gandhi for reviving a controversy surrounding the death of Judge BH Loya. Ravi Shankar Prasad tweeted, “The Loya judgement has been well settled by the Supreme Court. Those raising questions do not respect the judgment of the Apex Court pronounced after elaborate arguments. Does Rahul Gandhi consider himself above even the Supreme Court?”


Taking a dig at the Congress, the minister said, “We respect independence of judiciary. Record of Congress in compromising independence of judiciary, superseding judges even of Supreme Court during Emergency is well known.They rejoice only when the judgment is of their liking otherwise raise questions on the institutions itself.”


During the 3-hour hearing, Justice Muralidhar directed the Delhi Police Commissioner to watch all the videos of inflammatory speeches and file an FIR against BJP leaders Kapil Mishra, Anurag Thakur and Pravesh Verma. Muralidhar also played a viral video of Kapil Mishra in the High Court. The High Court has asked the police to submit the progress report on this matter on Thursday. Today a hearing will be held in the court of Chief Justice DN Patel.
