Nirbhaya Convict Files Curative Petition Against the Death Sentence in SC


In Nirbhaya case, the Patiala House Court of Delhi has stamped on the death warrant. The court has ordered the execution on January 22 at 7am. After which preparations are being made to hang these four accused in jail. One of the convicts in the 2012 Nirbhaya gangrape and murder case, Vinay Kumar Sharma, has filed a curative petition before the Supreme Court The petition has demanded a ban on hanging. Convict Vinay Sharma’s lawyer AP Singh said a curative petition in the Supreme Court seeking a stay on the death penalty.

All the four convicts will be hanged together at 7 am on 22 January in Tihar Jail No-3. For this, the Jail Department of UP has agreed to send the executioner to Tihar. Tihar Jail has asked for two executioners from UP. A curative petition is the last legal recourse available to a convict and it is generally considered in-chamber.

Jail officials say they will be hanged in the morning of 22 January. Before this, if they give mercy petition to the curator or the President, till then their hanging will be kept under consideration. Until a final decision is made about them. But now if his mercy petition is rejected in that case, then it may be difficult to give another 14 days time. Before this, they have been given time by giving notice. After the death warrant is issued on Tuesday, they are being given enough time of 14 days.
