Nirbhaya Case: Convicts Asks Delhi Court to Put Stay on their Death Sentence on 1 February

Another new twist has come in the Nirbhaya case the counsel for the convicts of Nirbhaya Case has approached Delhi Patiala House Court seeking a stay on the execution of the sentence on February 1. One of the convict Akshay Singh has requested the Patiala House court in Delhi for a stay on the February 1 hanging arguing that the convicts still have legal options to pursue.

Advocate AP Singh claimed in his plea that as per the Delhi Jail Rule, none of the four convicts of the same crime can be hanged unless all legal options including the mercy petition of the last convict are tried. Vinay Sharma, another convict sentenced to death in the Nirbhaya gang rape and murder case, curative petition will be heard by the judges in their chambers, not in open court. Even if the plea is rejected, he will have the option of sending a mercy petition to President Ram Nath Kovind.

Delhi’s Patiala House Court issued a death warrant on January 17 for the second time to hang the four convicts Mukesh Kumar Singh, Pawan Gupta, Vinay Kumar Sharma and Akshay Kumar Singh at 6 am on February 1. Even before this, the accused of Nirbhaya have adopted this method to avoid hanging many times.
