The bail plea of Narayan Sai, who had been convicted in a rape case, has been rejected by a division bench of Gujarat high court. Sai had approached the court, seeking bail and had put the Covid19 pandemic as the reason for seeking it. Sai in his plea sought bail on the grounds that Covid19 cases were being reported in the jail and he wanted to help out his family.
It should be noted that the Supreme Court had earlier directed that undertrials and others be released to reduce the risk of Covid19 transmission in jail. Sai has been convicted for life by a court in Surat in a rape case.
A bench of Justices JB Pardiwala and IJ Vora rejected the plea. Earlier on March 30, the high court had rejected a similar plea by Sai’s father Asaram. He too had sought bail on the grounds that he feared contracting Covid19 while in jail and that he was at a higher risk given his advanced age. Asaram is in jail after being convicted of sexual assault on a minor. He is also facing another rape case in a Gandhinagar court.
