Mumbai resident files complaint against Popular Builders for land grabbing in Thaltej

An 82-year-old woman has filed a case against Popular Builders accusing them of grabbing 10,522 sq mt of her land in Thaltej. The complaint names Popular Builders owner brothers Raman Patel, Dashrath Patel and Chagan Patel and six others.

It accuses them of using fake power of attorney to grab and sell the land belonging to the woman and her sister.
The complaint with Vastrapur Police Station has been made by Chanchadben Brahmbhatt, 82, a resident of Samarpan building in Borivali East. The compliant names Raman Patel, 65, his wife Mayuri, 62, Chagan Patel and his wife Kokilaben, Dashrath Patel and his wife Lataben, Sarita Patel and her son Krinesh Patel.

All the accused are residents of Ghanshyampark Society in Satellite. It also names Prathmesh Patel, 42 a resident of Navrangpura.

What the complaint against Popular Builders state

As per the complaint registered with Vastrapur police station, two pieces of land about 10,522 sq mt close to Thaltej village belonged to Chanchalben’s father Pochabhai Virambhai.
Pochabhai died on October 15, 1986, and the land passed on to his legal heirs- his wife Umiyaben and three daughters Hiraben, Kamlaben and Chanchadben.

Since it was agricultural land, the women did not go there as they were not in a position to carry out agriculture. Later Chanchadben came to know that Popular Builders owners Raman Patel and his family grabbed it through unfair means.

How the land was grabbed

The complaint states that Raman Patel used a fake signature of Chanchadben to create a power of attorney at the Ahmedabad Sub registrar’s office and sold the 10,522 sq ft of land on June 30, 2016, to Shree Saraswati Smruti Samudayak Kheti Sahkari Mandadi.

Interestingly, the Mandadi is as per rules not eligible to purchase agricultural land. On the day, the land was sold the same day Raman Patel created and registered the Saraswati Smruti Housing Society.

The housing society then bought the land and illegally got it registered in the revenue records.
They then divided the housing society into several smaller ones. Of this the Saraswati Smruti Co-operative Housing Society section 6 was changed to Saranga Co-operative Housing Society.

The land was then sold to Popular Builders and the person who did the documentation for Saranga Co-operative Housing Society was one Prathmesh Patel.
It is clearly stated that as per rule the agricultural land cannot be given to housing co-operative societies.
