Lower courts in Gujarat will reopen from July 1 onwards, a circular from the Gujarat High Court has said. The court will, however, function online through video conferencing thus neither lawyers, nor judges or parties concerned need to be physically present in the court room.
The high court in the circular said that in the present situation physical functioning of courts is not possible in view of a large number of positive cases.
It said in cases where physical appearance of the litigant/payee/beneficiary is necessary for the purpose of verification, arrangements can be made through time slots at designated rooms in court complex by adhering to social distancing norms. The court said upto 5 matters related to payment may be allowed which can eventually be increased.
It has also asked lower courts and the treasury to explore the RTGS mode of fund transfer and other electronic modes. In case of matters where oral hearing/argument is required it can be taken up through video conferencing, the HC said in the circular.
It also said that video conferencing booths with facilities for advocates to participate in the hearing through video conferencing should be arranged in one or two rooms of the court complex for those advocates who do not have the means to use video conferencing on their own.
