Kerala court: Sexual harassment case won’t stand if woman wearing sexually provocative dress

Kozhikode: A court in Kerala has raked up controversy with his comments during a bail hearing in a sexual harassment case.

The Kozhikode Sessions Court in Kerala was hearing a bail petition by author and social activist Civic Chandran.

The judge observed that charge of sexual harassment did not stand when a woman was wearing sexually provocative dresses.

Chandran, 74, had submitted the complainant’s photographs while applying for anticipatory bail.

“It would reveal that the de facto complainant is herself exposing to dresses which are having some sexual provocative one. So, Section 354A will not prima facie stand against the accused,” the court observed while referring to the photos.

The court further noted that for Section 354 to be invoked, there must be physical contact and advances “involving unwelcome and explicit sexual overtures… demand or request for sexual favours… sexually coloured remarks”.

The alleged incident had taken place in April, the accused said in his argument, adding that the complainant had come there with her boyfriend and that there were many people present at the place.
