Ishrat Jahan encounter case: Court asks CBI to seek state sanction to prosecute accused

A Special CBI Court on Friday directed the investigating agency CBI to seek Gujarat government’s sanction to prosecute ex-DySp Tarun Barot, IPS GL Singh and two other police officers allegedly involved in the Ishrat Jahan encounter case.

Special CBI Court while disposing of an application asked the CBI citing section 197 of CrPc (criminal procedure code) to seek sanction from the state government to prosecute the accused as they were public servants.

Of the four, JG Parmar an accused away on September 21 and his case has been abetted.

Earlier the Special CBI Court had discharged two accused – DG Vanzara and NK Amin in the fake encounter case after the state refused to grant sanction to CBI to prosecute them. Gujarat High Court appointed an SIT (Special Investigation Team) which found the encounters to be fake.

The CBI later registered a case against several Gujarat police officials including DG Vanzara, NK Amin and others in the alleged fake encounter case.

What is the Ishrat Jahan case?

Ishrat Jahan, a 19-year-old Mumbai-based girl, Javed Shaikh, Zeeshan Johar and Amjad Ali Rana were killed in an encounter by Gujarat Police near Kotarpur Water Plant in 2004. The police claimed that Ishrat and the three others had visited Gujarat to kill the then chief minister of the state Narendra Modi.
