Popular Builders: Gujarat High Court denies bail to Dashrath Patel

Aaquib Chhipa, Ahmedabad: The Gujarat High Court has rejected the bail application of Popular Builders’ Dashrath Patel in a domestic violence and dowry case. The case was filed by Patel’s daughter in law Fizu Patel.

Gujarat High Court while rejecting the bail of Dashrath Patel said two other FIRs are also registered against the applicant and therefore the aforesaid decisions would not render any assistance to the applicant. It said the prosecution has reasonable apprehension given the conduct of the applicant where he is accused of influencing the complainant and witness after the FIR was registered on August 24, last year.

“Hence if granted bail, the applicant may tamper with evidence and may once again try to threaten the first informant and witnesses,” the court said.

Advocate Mukul Rohtagi appearing for Dashrath Patel submitted before the court that the complainant in her statement didn’t mention the Rs.2.54 crore cash that she received nor made any reference to the demand drafts that she and her mother got.

Investigating officers recovered cash from the complainant’s aunt’s house. In the statement, the witness (Fizu’s aunt) said that her sister (Janki, Fizu’s mother) had given her the money for safekeeping while mentioning the dispute and the incident between the Popular Builders’ family members.

Jankit Patel allegedly forced the mother and her daughter (complainant) to go to his office but was still not made an accused and was instead shown as the witness in the case, he argued. The role of Jankit Patel was that he took the complainant and her mother to the office where Popular Builders’ Dashrath Patel allegedly threatened them to sign certain documents.

Rohtagi further argued that the court shouldn’t believe the story of the prosecution that the applicant has given threats and forced the first informant and mother to sign certain documents to settle the disputes.

The Public Prosecutor submitted before the court that the accused threatened the first informant and her mother and compelled them to sign certain documents. The allegations are serious. Based on the statement of the complainant (Fizu Patel) section 307 of IPC was added in the case, the prosecutor argued.

What is the case against Popular Builders?

As per the case details, Fizu’s in-laws and husband Maunang Patel began taunting her for not bringing enough dowry during a birthday celebration of her hubby.
Soon the taunt turned abusive and when Fizu objected, her husband slapped her several times and also punched her in the nose.

Her father-in-law and uncles who are associated with Popular Builders threw her out of her house and threatened that she would be killed if she filed a case against them. Later Fizu filed an FIR against her husband and in-laws with the Vastrapur Police Station.
