Court permits man accused of murder to undergo narco test

A court in Ahmedabad has permitted a man accused in a 2018 murder case to undergo a narco test.

The court allowed accused Jitendra Bhadoriya to undergo a narco test after he moved an application before the court seeking the same. The court directed the investigating officer to remain present during the test which will be conducted on a date given by FSL, Gandhinagar.

It also allowed the accused’s advocate to remain present with the investigating officer during the narco test process. The court sought a detailed report once the test is conducted.

Why petitioner sought narco test?

The petitioner’s counsel submitted before the court that at the time of the murder, the applicant was not present at the spot but was with his wife 10 km away. The counsel said the applicant also asked the investigating officer to take the statement of his neighbours and check his call records but this was not done.

Further, the applicant’s advocate argued that the deceased before he died at Civil Hospital named several other accused involved in the murder but had not mentioned the applicant’s name. The public prosecutor didn’t object to the narco test and hence the court after considering all aspects permitted the accused to undergo a narco test.

On October 5, 2018, some men murdered a 30-year-old man – Chandan Kumar near Asarwa Railway Lines. After the incident, a complaint was filed against several other accused including the applicant.
