A Gujarat woman has sent 150 condoms to Bombay High Court additional judge Justice Pushpa V Ganediwala to protest her controversial judgment in a POCSO case.
Media reports said the woman was identified as Devshri Trivedi who said she sent the condoms to different locations including Justice Ganediwala’s chamber, the registry of the Nagpur bench of the Bombay High Court, and the principal seat in Mumbai.
Calling the judge’s ruling in the POCSO case an injustice to the minor girl, she said the judge should be suspended.
Media reports said the registry office of the Nagpur bench did not receive any packets but many called for action against the woman.
What is the case of sexual assault?
The case pertains to a pre-teen girl who was groped by a man in 2016. A Nagpur bench of the Bombay High Court headed by Justice Pushpa Ganediwala ruled that since there was no “skin to skin contact”, the groping could not be ruled as an assault. The ruling said for it to be called a sexual assault there must be skin-to-skin contact with sexual intent and that mere groping was not sexual assault.
The verdict had come under severe criticism. Later the Supreme Court stayed the Bombay High Court’s controversial order acquitting the accused.
The sessions court had convicted the man and sentenced him to five years of rigorous imprisonment. He had appealed against the order in the high court.
The Supreme Court had also later withdrawn its recommendation to make Justice Ganediwala a permanent judge of the Bombay High Court.
