Residents of Vada village in Kutch has moved the Gujarat High Court challenging the collector’s order to allot a portion of village land to Gandhidham Municipality for solid waste disposal.
The division bench of Gujarat High Court has issued notice to the concerned authorities and sought a reply from them within a week. The villagers have sought quashing of the district collector’s order.
What the petition say in the petition before high court
Advocate Shakeel Qureshi representing the petitioner submitted before the high court that the collector allotted the land without following due to process of law and without complying with the provisions of Solid Waste Management Rules 2015.
Gujarat Pollution Control Board(GPCB) permission was not taken before allotting the land to Gandhidham Municipal authorities. The land is fertile and is used for agricultural purposes.
Despite several written representations by Vada Hamipar Gram Panchayat and Chandipar Gram Panchayat, no action was taken.
Hence the villagers have filed a PIL before the high court. The village Vada has a population of 1500 people and 500 cattle which largely depend on grass available in the vicinity of the village.
