The Supreme Court on Monday asked a man accused in the rape of a schoolgirl (now a major) and has been booked under POCSO (Protection of Children from Sexual Offences) law.
The SC was hearing a petition about the bail of one Mohit Subhash Chavan, a technician with the Maharashtra State Electric Production Company. “If you want to marry we can help you. If not, you lose your job and go to jail. You seduced the girl, raped her,” Chief Justice of India SA Bobde told the petitioner’s lawyer.
The petitioner has argued that his mother had offered marriage when the girl first went to the police to complain but she did not want to be married to him.
He alleged that the two then entered an agreement where he was to marry the girl when she turned major but then the man refused to marry her. It was then that the girl filed a rape complaint.
The Chief Justice then asked the accused if he would marry the girl.
The Chief Justice went on to add, “You should have thought before seducing and raping the young girl. You knew you are a government servant.” The Chief Justice also said that they were not forcing the accused to marry. “Let us know if you will. Otherwise, you will say we are forcing you to marry her.”
The accused in the rape case reportedly told the SC that he is now already married. He also pleaded that if he is arrested in the case he would be suspended as per the rules.
The trial court had granted Chavan protection from arrest but the High Court had cancelled it. The Supreme Court said he would not be arrested for four weeks and he could apply for regular bail.
