The Gujarat High Court on Thursday admitted and granted a stay on a petition that challenged the District Registrar of Cooperative Society’s decision to put a co-operative milk producer union in the C-category. Putting a co-operative under C-category indicates it is not performing well financially.
Interestingly, the milk co-operative that was put under the C-category was also the one through which former Dudhsagar Dairy Chairman Vipul Chaudhary had filed his nomination for the upcoming dairy elections.
Advocate Dipan Desai representing The Jodiya Kheralu Dudh Utpadak Sahakari Mandli Limited argued before the court that it was put under the C-category despite recording a good performance for the last many years.
It should be noted that Vipul Chaudhary had filed his nomination through The Jodiya Kheralu Dudh Utpadak Sahakari Mandli Limited.
The counsel argued that the District Registrar of Co-operative Society placed the co-operative milk producer union in the C- Category to disqualify Vipul Chaudhary from the upcoming dairy elections.
He said that the co-operative milk union auditor of the District Registrar of Cooperative Society prepares the audit report based on each cooperative’s performance.
The petitioner milk cooperative union, through which Chaudhary has filed his nomination, has been performing well for over two decades.
Milk cooperative unions who have lower points between 40 to 50 (based on their performance) are usually put in the C-category. The best performing milk cooperative unions are put under A -category.
He said in this case the petitioner milk union cooperative was placed in the C-category with an intent to disqualify Chaudhary.
Case against Vipul Chaudhary
Earlier Vipul Chaudhary filed a bail application before the Gujarat High Court after it was rejected by Ahmedabad Sessions Court.
The state CID Crime arrested Vipul Chaudhary, Moughi Chaudhary, and Nishit Bakshi in a case of financial irregularity. All the three accused were sent to judicial custody after their remand came to an end.
According to the FIR lodged with Mehsana B Division Police Station in 2014, ex-chairman Vipul Chaudhary carried out financial irregularities for personal gains. He was arrested by the CID crime 6 years after the registration of FIR.
Earlier former chief minister Shankersinh Vaghela had backed Chaudhary and said he has been targeted as part of a political witch hunt just weeks ahead of the dairy elections.
Chaudhary is one of the board of directors at Mehsana Dudhsagar Dairy and several of his supporters also occupy top positions in several dairies across the state.
