Court sentences HIV positive man to10 years in jail for sexually assault of 9-yr-old


Aaquib Chhipa, Ahmedabad: A Special Fast Track Court in Gujarat has sentenced an HIV positive man to 10 years in jail. The man was convicted of sexually assaulting a 9-year-old girl in Surat. The court also fined him Rs 25,000 and three additional years in jail if he failed to pay the fine.

The Special Court convicted Tunna Jenna, 34, for sexual assault and under IPC section 270 (malignant act likely to spread infection of disease dangerous to life).

Additional Public Prosecutor submitted before the court that despite knowing that he was HIV positive the accused sexually assaulted the minor girl.

The prosecutor argued that had the girl not been cautious at the time of the offense the accused could have committed a more serious offense against her.

“These sorts of cases are on the rise and the court should set an example by strict punishment,” the prosecutor argued.

The court also observed that such acts led to mental shock not only for the minor but also her family as the minor is not aware of the implications.

The court also directed the Surat district legal authority to deposit Rs 1.50 lakh as compensation to the minor girl under a 2019 government scheme.

The court ordered that 80% of the compensation amount should be deposited as a fixed deposit for a term until she becomes an adult and the rest should be paid to her parents.

What was the case of sexual assault before the court?

On January 27, 2019, the accused who lived close to the 9-year-old girl’s residence called her stating he wanted to take her measurements to stitch her clothes. He then sexually assaulted her. In the meantime, the child’s father arrived and the accused escaped from the spot.
