Aaquib Chhipa, Ahmedabad: A special court in Gujarat has sentenced a man to 1 year and 11 months in jail and fined him Rs5000 for holding the hands of a minor girl and making obscene gestures towards females. The court held Akhtar Shaikh guilty under section 12 of the POCSO Act.
The court said that if the accused fails to pay the fine he may have to undergo additional imprisonment of 10 days. The court directed that Rs3000 be paid as compensation to the minor girl. The 44-year-old accused worked as a labourer in a factory. The complainant in a statement told the court that the accused used to make explicit sexual gestures in front of women and run away.
The court further said that the accused has not been able to prove that he held the minor girl’s hand without any malafide intention and the deposition of the victim is such that it cannot be disbelieved.
The fact of the case is that an 11-year-old minor was on her way to tuition when the accused tried to hold her hands, but fortunately, she ran away from the spot at that time.
What was the case before the court?
After the incident, the accused used to make obscene gestures in front of the minor whenever she was sitting outside her house. Whenever she shouted for help the accused used to run away from the spot.
After the incident, a complaint was filed against the accused under IPC 354 and several provisions of the POCSO Act. Several other women in the locality including the mother of the minor girl told cops that the accused used to make obscene gestures at them and then run away.
