Court grants bail to 58-year-old accused in rape of minor


Aaquib Chhipa, Ahmedabad: A local court in Ahmedabad has granted bail to a 58 year old man accused of rape of a minor who was forced into sex by another accused who threatened to kill her parents.

Court while granting bail to the accused Kamlesh Shah observed that as the chargesheet has already been filed there is no possibility of tampering with evidence. Also at a time of pandemic, the trial will consume some time and hence the accused was granted bail.

Advocate Utkarsh Dave representing the petitioner submitted before the court that all the allegations against the accused are baseless and fake.

He said the petitioner suffered from blood pressure and diabetes. He argued that neither was the victim abducted nor forced into a physical relationship with the accused.

Also the chargesheet didn’t specify the same either. The petitioner further argued through his counsel that he was the sole breadwinner of his family and should be granted bail.

What public prosecutor said about rape accused

The public prosecutor opposed the bail arguing that a woman Varsha Nandubare had forced the 17 year old into prostitution by threatening to kill her parents.

The woman then forced the teen into a room with the accused where the said offence was committed. The prosecution argued that the accused can cause injury or threaten the victim, if released on bail, and hence the bail should be rejected.

According to the FIR lodged with Ramol Police Station by the complainant, her child was lured by Varsha and forced to have sex with the accused by threatening to kill her parents. Police had booked the accused under various sections of IPC.
