Proceeding in ADC bank defamation case to be suspended till next date of hearing: Gujarat High Court

Aaquib Chhipa, Ahmedabad: Gujarat High Court on Wednesday has directed the metropolitan court to consider the exemption application of ADC bank chairman Ajay Patel till the next date of hearing before the high court on March 10.

Gujarat high court further said that the proceedings in the criminal case before the metropolitan court shall be suspended till the next hearing before the high court. The high court has permitted ADC bank chairman Ajay Patel to submit an exemption application before the metropolitan court.

ADC bank chairman Ajay Patel had moved an application before Gujarat High Court to quash an order of the metropolitan court rejecting his exemption application. Gujarat High Court has also issued a notice to the state government.

The advocate representing Ajay Patel submitted before the Gujarat High Court that the applicant was suffering from COVID and he was advised to take rest by the doctor and hence he did not remain personally present before the metropolitan court and therefore, an application was submitted before the court for exemption and adjournment of the proceedings. However, it was rejected by the metropolitan court.

The applicant is suffering from post-COVID troubles and doctors had advised him to take a rest for two months. Therefore, he is not in a position to remain present before the metropolitan court on February 11, the advocate argued.

Earlier Congress leader Rahul Gandhi had filed a discharge application in the Metropolitan Court in Ahmedabad in connection with the Ahmedabad District Cooperative (ADC) Bank defamation case. He has contended the repeated absence of the complainant Ajay Patel, as a ground for his discharge from the case.

What is the ADC bank case?

As per the case details, the bank and its chairman are demanding action against Congress leaders for defaming them for converting old currencies worth Rs 745.59 crore during the demonetisation on November 8, 2016. Notably, BJP president Amit Shah was one of the directors of the bank at the time of demonetisation.
