The Gujarat High Court has set aside an imprisonment of 1,500 days awarded to a man by a family court in Ahmedabad for not paying maintenance to his wife.
The Gujarat High Court quashed the imprisonment after the wife approached it stating that she and her husband have decided to stay together for the better future of their two minor children.
A single-judge bench of the Gujarat High Court, while setting aside the family court order, observed that since the couple has decided to stay together, the husband needs to be released immediately from jail to make that possible.

Wife approached Gujarat HC
As per the case details, the wife had approached the Gujarat High Court challenging the order of the family court.
Notably, the family court had on March 29, 2019, imposed an imprisonment of 1,500 days after the wife approached it for recovery of maintenance. The wife had then alleged that her husband is not paying her the monthly maintenance of Rs 5,000 for the past 50 months.
