There is a strange debate between Election Commission and former Chief Election Commissioner. A week ago former Chief Election Commissioner SY Qureshi said that the EC should have filed an FIR in response to the hate speech during the Delhi elections. He raised serious questions on the actions of the EC. Now the EC has written a letter to Qureshi and has given answers to that question. The EC said that when they were the head of the EC, no action was taken against the leaders who violated the model code of conduct.
The Election Commission has also said that SY Qureshi, as Chief Election Officer, did not take any action even under the Representation of People Act. The controversy started when former CEC SY Qureshi wrote in an article in the English newspaper Indian Express on February 8 that the Election Commission should have lodged an FIR against those making inflammatory speeches during the Delhi Assembly election campaign.
In a letter to Qureshi on Thursday, senior deputy election commissioner Sandeep Saxena listed MCC notices issued by the poll panel when he was the CEC. The letter said no FIR was filed and “no action was taken by the then Commission during this period under Sections 123 and 125 of the Representation of People’s Act, 1951 and Section 153 of the Indian Penal Code”.
The Election Commission has written a letter to him against this article of SY Qureshi and said that when he himself was the Chief Election Commissioner of the country, he had not taken any action in such cases. Qureshi was the Chief Election Commissioner of the country from 30 July 2010 to 10 June 2012. Sunil Arora is currently the Chief Election Commissioner of the country. In a letter written to Qureshi, the Election Commission has said that from 11 February 2020, the Election Commission is going to release the list of action taken for violating the model code of conduct in the last 20 years. The Commission has said that when you were the Chief Election Commissioner of the country, the list of cases of violation of code of conduct and action taken on them during this period is also attached with this letter.
