Aaquib Chhipa, Ahmedabad: A local court in Ahmedabad has rejected the bail of an accused who allegedly stripped in front of a four-year-old girl in Ahmedabad.
The 42-year-old accused is a relative of the minor girl’s father, who is the complainant in the case.
The complaint by the child’s father alleged that the accused got nude in front of his minor daughter. Both the accused and the complainant live opposite each other.
The advocate appearing for the petitioner submitted before the court that the accused is suffering from skin disease since 2019 and is under treatment at LG Hospital and Shardaben Hospital.
The accused had stripped to apply some ointment on his genitals and meanwhile, the child entered the home of the accused.
What the court observed
The court while going through the medical papers submitted by the lawyer of the accused said that the medical paper from Shardaben Hospital was dated August 25. It referred to an Antigen test which was positive and the individual was advised home isolation for 14 days.
In the same way, the medical papers dated September 15 which were presented before the court were discharge papers. The documents from Civil Hospital dated October 28 refers to lower abdominal pain.
The court observed that none of the medical proofs submitted by the lawyer pointed to a skin disease as claimed by the accused.
It also pointed out that the medical papers did not show any medical advice to apply ointment on the genitals.
Court also took note of the fact that the accused and complainant are relatives and live opposite each other. The two have in the past owing to family problems filed numerous cross complaints against each other. The accused allegedly threatened to kill the complainant after the incident. The court thus said it was not inclined to grant bail.
As per the complaint the accused got naked in front of the minor and then ran away from the house.
