AMC seals 150 houses in Ashray apts in New Ranip after owners move in sans BU permission


Manoj Karia, Ahmedabad: Over 150 families in the Ashray Apartments 9 & 10 in new Ranip were left without a home after the Ahmedabad Municipal Corporation (AMC) sealed their premises.

The AMC sealed the apartments after the residents moved into the apartment without the builder getting the mandatory Building Use (BU) permission from the civic body.

The builders must get the BU permission before handing over the house but, the AMC’s action has left the residents in a lurch who are not protesting against the same.

How the flats were given sans BU permission from AMC?

In the year 2018. Tathya Infraspace Private Limited had come out with a 2BHK and 3 BHK scheme – Ashray 9 & 10 in New Ranip.

One scheme was a seven-floor building with four flats totalling 28 in all. The other scheme has ten floors with 40 units in all.

As per the details filed with RERA, the possession was to be given in March 2020. But as many of the home-owners had taken a home loan and were living on rent, they made a representation before the builder to let them take possession of the house.

The builder allowed them to move in but got a written undertaking from the owners stating that they are aware that the building lacks a BU permission but are moving in as they have no other option.

The builder had also informed the residents that he had already started the process to get the BU permission and it will be available within three to four months.

As a result, many had taken possession of their house but on Monday, the AMC sealed the houses.

Locals said that many residents had carried out the puja at their residence on the auspicious day of Dussehra and were planning to move into their homes today. Many were getting their homes decorated and work was still going on when the houses were sealed.

In fact, in some houses, the carpenters who were working had gone out for tea when the house was sealed and the workers ended up losing their tools too for the time the house remains sealed.

In some cases, the owners had locked the house and were at the office when their homes were sealed.

What the AMC notice said

The AMC in a notice said that the houses were being sealed for lack of BU permission. It also said that this was being done to ensure that other houses where owners have not moved in do not do so without the mandatory BU permission.
